PETITION FOR WRIT OF CERTIORARI
The Supreme Court’s review of a petition for a writ of certiorari is a matter of “judicial discretion.” Supreme Court Rule 10. What goes unsaid, but is nonetheless implied, is that the Court exercises its discretion judiciously. From 2000 to 2005, the Court reviewed, on average, 2,138 paid petitions each year and granted full review in approximately 87 cases. See Eugene Gressman, et al., Supreme Court Practice at 549 n.4, 550 n.6 (9th ed. 2007). Based on these figures, it is imperative that counsel file a professional, rule-compliant petition in order to attract the Court’s attention in a crowded docket.
